MV- 1. Plaintiff alleges the acts of defendants were negligent; the acts were the legal (proximate) cause of injuries and damages to plaintiff, the acts occurred on FEBRUARY 28, 2023 at OR NEAR FLORENCE AVE & CRAFTON AVE, BELL CA 90201
MV- 2. DEFENDANTS The defendants who operated a motor vehicle are (names): ANGEL PETHATAN HERNANDEZ, DOES 1 TO 5O INCLUSIVE
The defendants who employed the persons who operated a motor vehicle in the course of their employment are (names): LYFT, INC., DOES 1 TO 50 INCLUSIVE
The defendants who owned the motor vehicle which was operated with their permission are MAICON OMERO MUNOZ CARMANO, DOES 1 TO 50 INCLUSIVE
The defendants who entrusted the motor vehicle are MAICON OMERO MUNOZ CARMANO, DOES 1 TO 50 INCLUSIVE

SECOND CAUSE OF ACTION
GN- 1. Plaintiff DAVID QUINTERO PEREZ, an individual ; MIRIAM TREJO, an individual; VERONICA QUINTERO, an individual alleges that defendant (name) ANGEL PETHATAN HERNANDEZ, AN INDIVIDUAL; MAICON OMERO MUNOZ CARMANO, AN INDIVIDUAL; LYFT, INC., A DELAWARE CORPORATION; and DOES 1 to 50, inclusive was the legal (proximate} cause of damages to plaintiff. By the following acts or omissions to act, defendant negligently caused the damage to plaintiff on OR ABOUT FEBRUARY 28, 2023 at OR NEAR FLORENCE AVE & CRAFTON AVE, BELL, CA 90201
On or about February 28, 2023, Plaintiffs were lawful passengers in Defendant MAICON OMERO MUNOZ CARMANO’s vehicle traveling westbound on Florence Ave. near Crafton Ave.. Defendant ANGEL PETHATAN HERNANDEZ operated his vehicle westbound on Florence Ave directly behind Defendant MAICON OMERO MUNOZ CARMANO’s vehicle. Defendants operated their respective vehicles without caution and in such an unsafe manner that they violently collided.
Plaintiffs are informed and believe and thereon allege that Defendant ANGEL PETHATAN HERNANDEZ, an individual; MAICON OMERO MUNOZ CARMANO, an individual; LYFT, INC., a Delaware Corporation; and DOES 1 to 50, inclusive, negligently, carelessly, unskillfully, unlawfully, tortuously, wrongfully, maliciously, willfully, oppressively, and despicably entrusted, managed, maintained, operated, controlled and drove said vehicle.
In acting and in failing to act as aforementioned, Defendant ANGEL PETHATAN HERNANDEZ, an individual; MAICON OMERO MUNOZ CARMANO, an individual; LYFT, INC., a Delaware Corporation; and DOES 1 to 50, inclusive, acted in a negligent, reckless, careless and improper manner, and with negligence and disregard for the safety, rights, and well-being of others. In addition, it is alleged that each and every Defendant which will be found to have been an owner, registrant, lessor, lessee, bailor and/or bailee of the aforementioned Vehicle negligently entrusted said vehicle to the driver thereof, and that said Defendant was/were otherwise careless and negligent in the instance.
Plaintiffs are informed and believe, and upon that information and belief, allege that Defendants’ conduct constitutes negligence per se in that Defendants’ conduct violated California Vehicle Code section 22350 VC: “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” As a direct and proximate result of said acts and omissions on the part of the Defendants and each of them, Plaintiffs were hurt, and physically injured, sustaining medical bills, loss of earnings/earnings capacity, pain, suffering, loss of enjoyment of life and other damages, as well as substantial property damage, loss of use, towing, storage and other associated charges and damages, and will continue to sustain such damages in the future.
