NOTICE OF A PUBLIC HEARING FOR A

ZONING TEXT AMENDMENT

Notice is hereby given that a public hearing will be held before the DOWNEY CITY COUNCIL on the 13th day of May 2025, at 6:30 p.m., in the Council Chambers within Downey City Hall, 11111 Brookshire Avenue, Downey, California. At that time and place, consideration will be given to the following:

(PLN-25-00043) Zoning Text Amendment: A request to amend Article IX (Land Use) of the Downey Municipal Code, Sections 9124, 9146, 9148, and 9314, to regulate “Bars, Taverns, Pubs,” “Nightclubs,” and “Restaurants with Live Entertainment” land uses. The Zone Text Amendment (ZTA) to DMC Section 9314.04 –Commercial Zones Use Regulations– will 1) establish a 500’ (foot) buffer separation requirement between sensitive uses (“Schools, Public,” “Schools, Private,” “Child Day Care Center,” “Hospitals,” and City operated senior centers) and alcohol related land uses (“Bar, tavern, pub,” and “Nightclub,”) and “Restaurants with live entertainment”), 2) recategorize the existing land uses of “Micro-breweries and Brewpubs” and “Cafés and coffee establishments with live entertainment” as independent land uses, and 3) detail that “Bars, taverns, pubs,” “Nightclubs,” or “Restaurants with live entertainment” established prior to the effective date of said Ordinance shall not be subject to the 500’ buffer separation requirement. The ZTA also includes changes to 1) DMC Section 9124 –“B” Definitions– modifying the definition of a “Bar,” 2) DMC Section 9146 –“M” Definitions– modifying the definition of “Microbreweries and Brewpubs,” and 3) DMC Section 9148 –“N” Definitions– adding the definition of a “Nightclub.”

All interested parties are invited to submit written comments and/or to attend and give testimony. The agenda and staff report, which provides a detailed description and analysis of this project, will be posted to the City Boards and Commission Meetings page of the City’s website (http://www.downeyca.org) on the Friday prior to the public hearing.

As required by the California Environmental Quality Act (CEQA), this request has been found to be Categorically Exempt from CEQA, per Section 15061(b)(3), the “common sense” exemption, where it can be seen with certainty that there is no possibility that the Project will have a significant effect on the environment. The proposed Zone Text Amendment does not generate new land uses that are not already allowed within the City, and does not propose any physical construction. All new establishments will be individually analyzed once again per CEQA at the time of submittal of any application.
