NOTICE AND SUMMARY OF PROPOSED ORDINANCE
OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING ARTICLE IX (LAND USE) OF THE DOWNEY MUNICIPAL CODE RELATING TO ACCESSORY DWELLING UNITS AND JUNIOR ACCESSORY DWELLING UNITS (PLN-26-00036)
Notice is hereby given that on May 26, 2026, the City Council of the City of Downey will consider the adoption of Zoning Text Amendment to amend Section 9414 of Article IX of the Downey Municipal Code, regulating Accessory Dwelling Units (ADU) and Junior Accessory Dwelling Units (JADU). Below is a summary of the code amendments:
• Pursuant to AB 1154, local agencies cannot require owner occupancy for JADUs that do not share sanitation facilities.
• Pursuant to SB 543, the bill redefines how the total square footage of ‘interior livable space’ is taken and requires local agencies to submit an adopted local ordinance for compliance with the Department of Housing and Community Development (HCD).
At a duly noticed public hearing held on May 6, 2026, the Planning Commission considered the proposed Zoning Text Amendment and adopted Resolution No. 26-4062 by a 5-0 vote, recommending that the City Council approve the amendment.
